These Terms of Use apply when you visit or use this website. They should be read together with our Privacy Policy and, where relevant, any separate agreement or terms applying to a service you choose to use, such as a Coaching Agreement (“Service Terms”).

By using this website, you agree to these Terms. If you do not agree with them, please do not use the website.

1. About this website

This website is provided to help you understand who we are, what we offer and how you may choose to work with us.

Website content is general information only. We may update, change or remove content from time to time without notice.

Nothing on this website guarantees a particular coaching, career, leadership, business or other outcome from our services. People, circumstances and results differ, and you remain responsible for the decisions you make and the actions you take.

2. Using our website

You may use this website for lawful purposes consistent with its nature and purpose, including learning about our services, contacting us and making a booking.

Please do not use the website in a way that:

  • breaches any applicable law;

  • infringes another person’s rights;

  • interferes with another person’s use or enjoyment of the website;

  • attempts to gain unauthorised access to the website, its systems or data;

  • introduces malicious code or other harmful material;

  • alters, damages, defaces, disrupts or attempts to compromise the website, its content or security; or

  • uses the website or its content in a misleading, defamatory, abusive or otherwise unlawful way.

We may take reasonable steps to restrict access where we believe the website is being misused, or where this is reasonably necessary for security, legal, technical or operational reasons.

3. Intellectual property

This website contains material owned by us, licensed to us or used with permission. This may include text, photographs, graphics, design elements, branding, logos, video, audio, documents, downloadable resources and other content.

Unless otherwise stated, copyright and other intellectual property rights in material created by us or on our behalf remain owned or controlled by us.

4. Our services, coaching and prices

Nature of coaching

The International Coaching Federation (ICF) defines coaching as:

“Partnering with clients in a thought-provoking and creative process that inspires them to maximize their personal and professional potential.”

In coaching, the coach brings professional skill, structure, focused listening, questioning, challenge, reflection and, where useful, appropriate tools or observations. The aim is to help the client think more clearly, develop insight and identify useful ways forward.

The client brings their own context, goals and judgement and remains responsible for their decisions and actions.

Nothing in this section limits our responsibilities under the Service Terms or applicable law.

Coaching is not therapy, counselling, or medical, psychological, legal, financial or other regulated advice or treatment, and we do not provide those services through coaching.

Where appropriate, we may discuss whether another professional or service could better meet your needs.

We may also offer other kinds of services, such as workshops, assessments, mentoring, professional development or advisory work. Those services will be described separately and may have their own Service Terms.

Services may also be delivered through appropriately engaged employees, contractors, facilitators or other practitioners as the business develops.

Enquiries, bookings and Service Terms

Browsing this website, sending an enquiry or making a booking does not, by itself, start a coaching or other professional-services engagement.

A booking reserves a time. Any booking or cancellation conditions that apply will be made available before you confirm the booking.

If we offer an introductory conversation, its purpose is to explore what you are looking for and whether working together may be useful. An introductory conversation is not itself a coaching engagement.

Information you share with us during an enquiry or introductory conversation will be treated as confidential, subject to our Privacy Policy and any disclosure required or permitted by law.

Before a paid service begins, the Service Terms that apply to that service will be made available and agreed.

If these Website Terms conflict with Service Terms applying to a particular service, the Service Terms will apply to that service, subject always to rights that cannot lawfully be excluded.

Prices and service information

We aim to describe our services, fees and inclusions clearly and accurately.

Prices displayed publicly on this website are in Australian dollars and include GST unless we clearly state otherwise.

Organisational or other individually scoped engagements may be quoted separately, with any applicable GST clearly identified in the relevant quote or Service Terms.

Where a service requires a separately supplied assessment, report, licence or other third-party product, we will make the total amount payable clear before you purchase or book the service. We may also identify and invoice the third-party component separately, including where it is supplied at cost.

We will confirm the relevant scope, timing and fees before a paid service begins.

While we take reasonable care with information on the website, mistakes can occur. If we discover a material error in a price or service description before you are charged, we will tell you and you can choose whether to proceed on the corrected basis.

5. Privacy

We take your privacy seriously.

Our Privacy Policy explains the personal information we collect, why we collect it, how we use and disclose it, how we handle and protect it, and how you can contact us about privacy.

The Privacy Policy is available through this website and should be read together with these Terms.

6. Cookies and website technology

This website uses cookies and similar technologies to make it work and to help us understand how it is used. Some of these technologies are provided through Squarespace and other services we use to operate the website.

When you first visit, we ask for your choice using a cookie banner. You can accept all cookies, manage them or decline the non-essential ones, and you can change your choice at any time using the cookie settings on this site. Our booking page, provided by Calendly, has its own cookie settings.

More information about cookies and related technologies is provided in our Privacy Policy.

7. Security and availability

This website is hosted using Squarespace, which provides security features as part of its website hosting service.

We also take reasonable steps to use appropriate systems and security practices. However, no website, online service or transmission over the internet can be guaranteed to be completely secure, continuously available or free from errors or harmful material.

Accordingly, we do not guarantee that:

  • the website will always be available or uninterrupted;

  • every error or defect will immediately be corrected;

  • the website will always be free from malicious software or third-party interference; or

  • information transmitted over the internet will always be secure.

Please do not send sensitive information, such as detailed health, financial or identity information, through website forms or ordinary email unless we have agreed an appropriate way to exchange it.

You are responsible for maintaining appropriate security protections on your own devices and systems.

8. Links and third-party websites

Our website may contain links to websites, resources, booking platforms, professional organisations, social media pages or services operated by third parties.

We provide these links because they may be useful or relevant. Unless we expressly say otherwise, including a link does not mean that we control, endorse or accept responsibility for that third party or everything it publishes or provides.

External websites and services have their own terms, privacy practices and security arrangements. You should satisfy yourself that these are appropriate before using them or providing personal information.

From time to time, we may have a professional, commercial, referral, affiliate or other relationship with a third party mentioned or linked on this website. Where that relationship is material to the context, we will disclose it appropriately.

Links to our website

You are welcome to link to publicly available pages on our website, provided the link is lawful and fair and does not:

  • misrepresent your relationship with us;

  • suggest sponsorship, endorsement or affiliation where none exists;

  • place our content in a misleading, inappropriate or unlawful context; or

  • misuse our name, reputation or intellectual property.

If we reasonably believe a link is misleading, unlawful or otherwise inappropriate, we may ask you to remove it.

9. Communications and material you send us

You may contact us through the website, by email or through other channels made available on the site.

Please provide information that is accurate to the best of your knowledge and do not knowingly submit material that is unlawful or infringes another person’s rights.

We treat information you provide in an enquiry or booking as confidential, subject to our Privacy Policy and any disclosure required or permitted by law.

We use that information to respond to you, arrange services and, where you engage us, deliver those services. Any additional confidentiality obligations contained in your Service Terms will then also apply.

We do not treat material sent to us as automatically available for unrestricted public or commercial use.

We will only publish a testimonial or identify you publicly as a client with your written permission, including permission given by email.

If you provide a photograph, idea or other material for possible public use, we will obtain appropriate permission before publishing identifiable or non-public material.

We may use general, non-confidential feedback to improve our services, provided that doing so does not identify you or disclose confidential or personal information without appropriate permission.

10. Disclaimer and liability

This section concerns your use of the website.

Our responsibility for services that we agree to provide is governed by the Service Terms applying to those services and by applicable law.

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy, condition or warranty that cannot lawfully be excluded or limited, including rights available under the Australian Consumer Law.

Where the Australian Consumer Law applies, services may carry consumer guarantees, including that applicable services be provided with due care and skill.

General website information

Information on this website is general in nature.

Subject to rights and obligations that cannot lawfully be excluded:

  • you use the website and its general information at your own discretion;

  • you are responsible for considering whether information is appropriate to your own circumstances;

  • you should obtain appropriately qualified advice where your circumstances call for specialist professional advice;

  • we do not guarantee that general website information will be complete, error-free or suitable for every person or circumstance; and

  • information may become incomplete or out of date between updates.

We take reasonable care to keep website information accurate.

To the extent permitted by law, we are not responsible for loss you suffer because you relied on general website information as though it were advice tailored specifically to you, or because information had become out of date.

Third-party services and events outside our control

To the extent permitted by law, and except where our own failure to take reasonable care caused or contributed to the loss, we are not responsible for:

  • the content, availability, accuracy, privacy practices or security of third-party websites or services we do not control;

  • interruptions or failures affecting the website caused by telecommunications providers, hosting services or other systems outside our reasonable control; or

  • malicious or unlawful conduct by unrelated third parties.

Indirect loss and people who work with us

To the extent permitted by law, we are not liable for indirect or consequential loss, or loss of profit, arising from your use of the website, as distinct from services provided under Service Terms.

To the extent permitted by law, the protections in this section also apply in relation to claims arising from acts or omissions of our directors, employees and contractors acting in connection with the website.

Indemnity

If you use the website unlawfully or in material breach of these Terms, or submit material that is unlawful, infringing or that you are not entitled to provide, you indemnify us against loss, liability and reasonable costs, including reasonable legal costs, that we incur as a result, including through a third-party claim.

The indemnity also applies where your use of the website was otherwise permitted but a third party makes a claim against us because of something you did or material you provided that you knew, or ought reasonably to have known, was likely to give rise to that claim.

The indemnity applies only to the extent that the relevant loss, liability, claim or cost was caused by your act, omission or material.

It does not apply to the extent that the relevant loss, liability, claim or cost was caused or contributed to by our negligence, breach of these Terms, unlawful conduct or failure to comply with an obligation that cannot lawfully be excluded.

We will act reasonably in dealing with any claim and in taking steps to limit our costs.

11. Changes to the website and these Terms

We may update the website and these Terms from time to time.

When these Terms are changed, the revised version will be published on the website and the Last updated date will be changed.

The revised Terms apply to your use of the website from the time they are published.

Changes to these Terms do not affect bookings already confirmed or Service Terms already agreed.

12. Access to the website

We may suspend, restrict, change, withdraw or discontinue some or all of the website where reasonably necessary, including for maintenance, security, legal, technical or business reasons.

This does not affect bookings already confirmed or services we have already agreed to provide under Service Terms.

We may also restrict access where the website is being used unlawfully or in material breach of these Terms.

Provisions which by their nature are intended to continue after access ends, including those dealing with intellectual property, liability, indemnity and governing law, will continue to apply.

13. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be treated as severed or limited to the minimum extent necessary.

The remainder of these Terms will continue to apply.

14. Governing law and resolving concerns

These Terms are governed by the laws in force in Victoria, Australia, including applicable Commonwealth laws.

If you have a concern about this website or these Terms, please contact us first. We would prefer to understand the issue and, where possible, resolve it promptly, fairly and without unnecessary cost or formality.

This does not prevent you from contacting Consumer Affairs Victoria or another regulator, or from exercising any right you have to bring a matter before a court or tribunal, including VCAT where it has jurisdiction.

The courts and tribunals of Victoria, and courts with jurisdiction to hear appeals from them, have non-exclusive jurisdiction in relation to these Terms, subject to any right you may have under applicable law to bring proceedings elsewhere.
